CONSENT, RELEASE, and WAIVER

I hereby state as follows:

1. I am the parent/legal guardian and I am duly authorized to act for and on behalf of my child.
2. I am allowing my child to participate in the Cheez Whiz Try-Athlon. In doing so, I am:
   1. Agreeing to the Terms and Conditions of the Cheez Whiz Try-Athlon.
   2. Giving permission to Mondelez Philippines, Inc., its affiliates, licensees, successors and assigns, officers, directors, employees, agents, and those acting under their authority (collectively, “MDLZ”), to record, photograph, film, or otherwise capture my child’s name, likeness, voice, actions and biography (collectively, “Likeness”), and to use, and to authorize others to use, my child’s Likeness and pictures/videos in any media or platform for any purpose (including consumer research, publicity, and promotion) in perpetuity and throughout the world and without additional compensation;
   3. Releasing, waiving, and forever discharging MDLZ from any and all claims, actions, demand, suits and liability relating to or arising from my child’s participation in the Cheez Whiz Try-Athlon, including injury that my child will sustain in his/her participation therein, of whatever nature, expected, real or apparent, now or in the future, against MDLZ under any contract or statute; and
3. I will indemnify and, if requested by MDLZ, defend MDLZ from and against any and all losses, damages, fines, penalties, and expenses (including reasonable legal fees) arising from claims related to my child’s breach of any of the Terms and Conditions and of this Consent, Release, and Waiver.
4. I finally declare that I have read and fully understood this document, and the release, waiver and quitclaim hereby given is made willingly and voluntarily and with full knowledge of my and my child’s rights under the law.
